Music Submission Terms and Conditions

Effective Date: [9/10/2026]

These Music Submission Terms and Conditions apply to music submitted to Top Music Attorney Podcast/The Takeover/Top Music Attorney and operated by Top Music Attorney, referred to below as “we,” “us,” or “our.”

By submitting music through the Free Line or Jump the Line, you acknowledge and agree to the following:

Eligibility

You must be at least 18 years old to submit music.

If you are under 18, your parent or legal guardian must submit the music for you and agree to these terms. We do not accept submissions from anyone under 13

No Generative AI Accepted

We do not accept music created using generative artificial intelligence.

This includes AI generated music, instrumentals, vocals, voice clones, lyrics, melodies, or compositions, whether created entirely or partially using generative AI.

AI assisted mastering is currently allowed, provided generative AI was not used to create or materially replace any part of the music, vocals, lyrics, composition, or human performance.

We may change our AI submission standards at any time.

Your Ownership and Permissions

You confirm that you own the submitted music or have received all rights, licenses, permissions, and approvals necessary to submit it and allow us to use it as described in these terms.

This includes permission involving:

  • The sound recording

  • The underlying music and lyrics

  • Co-writers and co-owners

  • Producers and featured artists

  • Record labels, publishers, and administrators

  • Beats, samples, interpolations, and other third-party material

  • Album artwork, photographs, music videos, and other submitted materials

  • The artist’s name, stage name, image, likeness, and social media information

Do not submit cover songs, uncleared samples, leased beats, or other third-party material unless you have the authority necessary to permit the uses described in these terms.

Permission to Use Your Submission

You grant us a nonexclusive, worldwide, royalty free license to listen to, review, publicly perform, display, reproduce, record, livestream, edit, excerpt, discuss, and feature your submission.

This permission includes use on our podcast, livestreams, YouTube videos, social media accounts, websites, promotional materials, clips, compilations, advertisements for the show, and other related content.

We may monetize content containing your submission. You are not entitled to a share of our advertising revenue or other direct compensation from us because your music was submitted, reviewed, or featured, except for any non-waivable royalties or payments that may apply under law or separate third-party agreements.

This permission includes the right to keep previously published livestreams, videos, clips, and archived content available after the review occurs.

Public Commentary and Editorial Control

You understand that your music may be discussed publicly.

Any opinions, reactions, criticism, jokes, or feedback expressed during the show are subjective. We do not guarantee that the reaction will be favorable.

We decide whether to play a submission, when it will be played, how much will be played, whether we skip through portions, and when we stop playing it. You do not have approval rights over our commentary, editing, title, thumbnail, or presentation.

A submission does not guarantee exposure, followers, streams, sales, professional opportunities, or any other result.

Free Line

Free Line submissions are selected at our discretion and may be selected randomly.

Submitting through the Free Line does not guarantee that your music will be played, reviewed, featured, discussed, or receive feedback.

There is no guaranteed waiting period or position in the Free Line.

Submitting the same song more than once does not increase the likelihood that it will be selected and may result in the duplicate submissions being removed.

Songs over 4min in length may not be played all the way through

Jump the Line

Jump the Line costs $10 per song. One payment covers one song only.

You will be taken to the payment screen after submitting the form. Your song will not enter the Jump the Line queue until payment is successfully completed.

Jump the Line means that an eligible paid submission receives priority over Free Line submissions. It does not guarantee:

  • A particular show or broadcast date

  • Immediate playback

  • Placement ahead of other paid submissions

  • Playback of the complete song

  • A particular amount of airtime

  • Detailed feedback

  • A positive reaction

  • Promotion outside the show

  • Any increase in followers, streams, sales, or other results

We will make reasonable efforts to play an eligible Jump the Line submission on the show submitted, within 7 days, or 2 shows.

If we decide not to play an otherwise eligible paid submission, our sole obligation will be to refund the submission fee.

Superchats will NOT be accepted as payment for jumping the line. It must go through jump the line link.

Songs over 4min in length may not be played all the way through

No refund will be issued after any portion of the submitted song has been played. Refunds are also unavailable when we cannot access or play a submission because the link is broken, private, expired, restricted, removed, or contains inaccurate information, provided we have given you a reasonable opportunity to correct the issue.

If a livestream is canceled or a technical problem prevents playback, we may move the submission to a future show instead of immediately issuing a refund.

Submission Requirements

You are responsible for providing a working link that allows us to access and play the song.

You must keep the link active and publicly accessible until the song has been reviewed or you h

ave been notified that it will not be used.

We are not responsible for broken links, private files, geographic restrictions, account restrictions, platform removals, playback failures, or other problems outside our reasonable control.

Copyright Claims and Content ID

You agree not to knowingly issue or authorize a copyright claim, Content ID claim, takedown request, or similar complaint against our authorized use of your submission.

If your distributor, label, publisher, administrator, or another third party automatically issues a claim, you agree to make reasonable efforts to have the claim released promptly.

This provision does not prevent you from addressing a use that falls outside the permission granted by these terms.

Content Standards

We may reject, skip, stop playing, or remove any submission that:

  • Violates these terms

  • Contains generative AI

  • Infringes another person’s rights

  • Contains unlawful material

  • Contains hate speech, threats, harassment, or exploitative content

  • Is deceptive or submitted using false information

  • Is otherwise inappropriate for our audience or platform

  • Exceeds 4 mins in length

A payment does not require us to play content that violates these standards.

No Confidentiality or Attorney/Client Relationship

Music submissions are not confidential.

Do not include confidential, privileged, legally sensitive, or unreleased information that you do not want publicly discussed.

Submitting music does not request legal services and does not create an attorney/client relationship with Delgado Entertainment Law, Krystle Delgado, Top Music Attorney, or any affiliated attorney or business.

Nothing said during a reaction, review, livestream, podcast, or video should be considered legal advice.

Third-Party Platforms

Our forms, payments, livestreams, videos, and communications may use third-party services such as Wufoo, payment processors, Restream, YouTube, and social media platforms.

Those services operate under their own terms and privacy practices. We are not responsible for their outages, restrictions, processing, removals, copyright systems, or independent use of information.

Use of Your Music and AI

We do not use submitted music to train, develop, fine-tune, or improve our own artificial intelligence or machine-learning models.

We do not separately sell or license submitted music to third parties for AI training as part of this submission program.

However, content publicly featured through YouTube, social media, hosting providers, or other third-party platforms may be processed under those platforms’ own terms and policies. We cannot control or guarantee how an independent platform processes content hosted through its services.

Email and Privacy

We may use your contact information to communicate with you about your submission, payment, scheduling, technical issues, or the show.

Marketing emails, newsletters, and promotional announcements should be subject to a separate optional consent. You may unsubscribe from marketing emails at any time using the unsubscribe link included in those messages.

Unsubscribing from marketing emails will not prevent us from sending necessary communications concerning your submission or payment.

Release and Limitation of Liability

To the fullest extent permitted by law, you release us and our owners, employees, contractors, hosts, attorneys, affiliates, and production partners from claims arising from an authorized review, reaction, discussion, editing, or public use of your submission.

We are not responsible for lost opportunities, lost profits, reputational concerns, audience reactions, platform actions, copyright claims caused by information you provided, or indirect or consequential damages.

Our total liability arising from a Jump the Line submission will not exceed the amount you paid for that particular submission, except where a limitation is prohibited by law.

Indemnification

You agree to defend, indemnify, and hold us harmless from third-party claims, damages, losses, liabilities, and reasonable expenses arising from:

  • Your breach of these terms

  • Your submission

  • Your lack of ownership or permission

  • Infringing or unauthorized material in your submission

  • False or inaccurate information you provide

  • A claim brought by a co-writer, label, publisher, producer, featured artist, distributor, or other rights holder

No Endorsement

Playing, reviewing, or discussing a song does not mean that we endorse, recommend, represent, manage, or have an ongoing business relationship with the artist.

Jump the Line is a paid priority submission service. Payment does not purchase praise, approval, or an endorsement.

Changes to These Terms

We may update these terms from time to time. The version in effect when you submit your music will apply to that submission.

Governing Law

These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Any legal action relating to these terms must be brought in a state or federal court located in Maricopa County, Arizona, unless applicable law requires otherwise.

If any part of these terms is found unenforceable, the remaining provisions will remain in effect.

Acceptance

By submitting the form, you acknowledge that you have read, understood, and agreed to these Music Submission Terms and Conditions.
